With the new Financial Services Act (FinSA) and the Financial Institutions Act (FinIA) the existing financial market regulation has been undergone some sweeping reforms. The FinSA governs the prerequisites for providing financial services and offering financial instruments, while the FinIA establishes a prudential supervisory regime for all asset managers, including todays independent asset managers. As the last transitional provisions will expire by the end of this year, it is a good time to check whether you are ready. The aim of this presentation is to provide an overview of the main implications of the new regulation for asset managers and fund providers including topics like conduct rules, crossborder regulations (inbound) and licensing regimes. Additionally, a brief overview of selected other topics will be presented.
